Diligent Corporation and its group companies (also referred to here as the “Diligent Group”) are engaged in providing a range of corporate governance, risk, and compliance software-as-a-service offerings to businesses of all sizes around the world. A list of our subprocessors is below.
In the course of providing these services to our customers, the contracting Diligent Group company may rely on other Diligent Group companies or other third parties who process personal data in the course of performing services for customers. In this context, such third parties are referred to as subprocessors.
The Diligent Group conducts due diligence on the practices of subprocessors and requires each subprocessor to be bound by contractual provisions in accordance with the requirements of applicable law (including Article 28 of the General Data Protection Regulation). Diligent Group companies are responsible for their subprocessors in accordance with the terms agreed to in relevant contracts with customers, including applicable data processing terms.
Current Diligent Group customers with data processing terms in place with a Diligent Group company may subscribe to receive notification of new subprocessors before such new subprocessors process personal data in connection with the provision of the Diligent product in accordance with this page.
A customer with data processing terms in place with a Diligent Group company may object to the use of a new subprocessor by sending a notification to privacy@diligent.com within ten (10) business days of receipt of notice of a new subprocessor provided that the customer reasonably believes that use of such subprocessor presents an unreasonable risk to or prevents the customer from complying with applicable law. If the company so objects, the Diligent group company shall either (a) not use the new subprocessor to process the customer’s personal data or (b) shall find an alternative way of reasonably resolving the customer’s objection. If neither (a) nor (b) is reasonably feasible within thirty (30) days of receipt of the customer’s objection, then the customer shall have the right to terminate any services for which the new subprocessor would be used by providing written notice to the Diligent group company at the address for notices indicated in the relevant contract.
